The decision is seen as a major win for utilities, according to Seth D. Jaffe with Foley Hoag LLP law firm.Several environmental groups sued the plant saying the replacements were a violation of PSD and NSR reviews. Bull Run replaced its economizer and superheater sections. Judge Thomas Varlan ruled that replacing the plant’s economizer and superheater had been done before throughout the industry and would not be subject to U.S. Environmental Protection Agency regulations because it was a common procedure. The judge also ruled that the cost of the project was not unusual.
